Terms and Conditions of Service

These Terms and Conditions govern the use of shipping, freight forwarding, cargo handling, and related services provided by EMPIRELINK SHIPPING LTD. By using our services, customers agree to be bound by these Terms and Conditions.
EMPIRELINK SHIPPING LTD. provides international and domestic shipping, freight forwarding, customs brokerage assistance, cargo consolidation, package handling, and delivery services within Jamaica and internationally.
All services are subject to applicable Jamaican laws, customs regulations, and carrier requirements.
The Customer agrees to:
Provide accurate and complete shipping information.
Ensure all shipments comply with Jamaican laws and regulations.
Properly package items to prevent damage during transit.
Declare the true nature, value, and contents of all shipments.
Pay all applicable fees, duties, taxes, and charges.
The Company reserves the right to refuse any shipment that violates applicable laws or these Terms.
Customers shall not ship:
Illegal drugs or controlled substances.
Firearms, ammunition, explosives, or weapons.
Hazardous materials unless approved and properly documented.
Counterfeit goods.
Stolen property.
Perishable goods without prior approval.
Any item prohibited by Jamaican Customs Agency, the shipping carrier, or destination country regulations.
The Company may inspect shipments where required by law or for security purposes.
Shipping rates are determined based on:
Weight and dimensions of packages.
Destination.
Type of service selected.
Applicable taxes, duties, customs fees, and surcharges.
Rates are subject to change without notice.
The Customer is responsible for:
Customs duties.
Import taxes.
Government fees.
Customs penalties arising from inaccurate declarations.
The Company acts only as an intermediary and is not responsible for customs delays, inspections, or seizures by government authorities.
Estimated delivery times are provided for guidance only.
The Company does not guarantee delivery dates and shall not be liable for delays caused by:
Customs inspections.
Weather conditions.
Carrier disruptions.
Port congestion.
Strikes.
Government actions.
Force majeure events.
Claims for lost or damaged shipments must be submitted:
Within seven (7) days of delivery for damaged goods.
Within thirty (30) days of the expected delivery date for lost shipments.
Claims must include:
Proof of shipment.
Photographs of damage (if applicable).
Proof of value.
Failure to submit required documentation may result in denial of the claim.
Unless additional insurance has been purchased, the Company's liability shall be limited to the lesser of:
The declared value of the shipment; or
JMD $15,000 per shipment.
The Company shall not be liable for:
Indirect or consequential losses.
Loss of profits.
Business interruption.
Emotional distress.
Delays beyond our reasonable control.
Customers may purchase optional cargo insurance for eligible shipments.
Insurance coverage is subject to the insurer's terms, conditions, exclusions, and claim procedures.
Packages remaining unclaimed for more than 3 weeks after notification may be:
Returned to sender at the Customer's expense.
Sold, disposed of, or otherwise handled as permitted by law to recover outstanding charges.
Packages not collected within 7 days of notification may incur storage fees of $150 per day.
Payment is due upon receipt unless otherwise agreed in writing.
The Company reserves the right to:
Withhold delivery of goods.
Suspend services.
Charge reasonable collection costs and interest on overdue balances.
Accepted payment methods include:
Bank transfer
Cash
Customer information will be collected and processed solely for the provision of shipping services and compliance with legal obligations.
The Company will take reasonable measures to protect customer information in accordance with applicable Jamaican laws.
The Company shall not be liable for any failure or delay resulting from circumstances beyond its reasonable control, including natural disasters, pandemics, labor disputes, government actions, war, civil unrest, or transportation disruptions.
These Terms and Conditions shall be governed by and interpreted in accordance with the laws of Jamaica.
Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Jamaica.
The Company reserves the right to amend these Terms and Conditions at any time. Updated versions will become effective upon publication on the Company's website or notice to customers.
For assisted online shopping services:
Full payment must be deposited in advance
Customers must confirm item details before purchase
Payments may be non-refundable once purchase is made
Empirelink Logistics is not responsible for vendor errors, delays, cancellations, incorrect items, or sizing issues
All refund or exchange matters remain between the customer and the vendor.

By shipping goods through EMPIRELINK SHIPPING LTD., the Customer acknowledges that they have read, understood, and agreed to these Terms and Conditions.
